What to Do After a Loved One Passes Away Due to Negligence

What to Do After a Loved One Passes Away Due to Negligence

In the United States alone, over 100,000 wrongful death cases are filed each year. This means all these deaths were in one way or another because of someone else’s negligence. When you lose a loved one in such a manner, you are faced with several challenges, including finances and the feeling that their death could have been prevented.

During this difficult time, it is important to know that you have options and support. Additionally, you might need a wrongful death attorney to guide you through filing a claim and presenting the right evidence. Here is what you can do after losing someone due to negligence.

Take Immediate Steps After the Accident

As difficult as the aftermath can be, there are a few important things to do right away. First, make sure you notify the proper authorities. If the incident involved a car accident, medical malpractice, or property hazards, a police report or investigation should be started right away. This documentation is very important if you decide to take legal action later on.

If possible, collect and preserve evidence. This can include photographs of the accident scene, medical records, contact information of any witnesses, or anything else that might explain what happened.

Also, avoid speaking with insurance companies or representatives from the at-fault party until you speak to a lawyer. This is because they may try to get you to settle quickly or say something that could be used against you.

Consult a Wrongful Death Attorney

Speak with an experienced wrongful death attorney as soon as possible. They understand what you are going through and can help you navigate the legal system during this tough time. A lawyer will investigate the case on your behalf, determine who was at fault, and help you understand if you have a valid claim.

An attorney can also deal with insurance companies on your behalf, so you don’t have to worry about making mistakes or being taken advantage of. It is important to act quickly to avoid missing the statute of limitations timeline. Waiting too long could mean losing your chance to file a claim. Additionally, some wrongful death attorneys work on a contingency basis; therefore, you don’t have to worry about incurring upfront costs.

Understand the Type of Compensation You May Be Entitled to

No amount of money can replace a loved one. However, financial compensation can help you with the financial burden that comes after a loss. In a wrongful death claim, you may be able to recover:

  • Medical bills related to the incident
  • Funeral and burial costs
  • The income your loved one could have provided
  • Loss of companionship
  • Pain and suffering

In some cases, especially when the negligence was extreme, courts may also award punitive damages to punish the party responsible.

Address Emotional and Practical Matters

Dealing with the emotional and practical side of things is just as important. Reach out for help, whether that is through a grief counselor, support group, or trusted friends and family. Do not carry this weight alone.

At the same time, there are other practical matters that need attention, such as handling your loved one’s estate, managing accounts, or going through probate if need be. All these things can be overwhelming. Therefore, do not hesitate to ask others for help with these tasks and consult an attorney where necessary.

Conclusion

There isn’t an easy way or a roadmap to deal with the death of a loved one, especially when the accident could have been prevented. Nevertheless, you don’t have to go through it alone. Taking the right steps can bring some sense of justice and help you with your healing process.
